IF MORE THAN 5 TRUCKS AND/OR 10 TRAILERS ARE TO BE ON SITE, THE APPLICANT SHALL APPLY FOR AN AMENDMENT TO THE CONDITIONAL USE PERMIT. 8. THE OUTDOOR TRAILER PARKING AREA WILL BE SURFACED WITH A MINIMUM OF CLASS V. MOTION CARRIED 7-0. 5.2. Request by STM Development for Conditional Use Permit,Case No.CU 04-16 Senior Planner Scott Harlicker explained that STM Development is requesting a conditional use permit to construct a 7,900 square foot multi-tenant building including a Class 2 restaurant (Taco John's) and retail space. Mr.Harlicker reviewed the site plan,parking and access,pedestrian access,landscaping and building elevations. Staff recommends approval of the request with the four conditions listed in the staff report dated May 25,2004. Commissioner Pederson asked what signage would be allowed. Mr.Harlicker stated that one wall sign is permitted per tenant space,and one monument sign for the site. Chair Ropp opened the public hearing. Jay Tutt,representing STM Development, stated that in lieu of a monument sign,the PUD Agreement was amended for the Panera site to allow two wall signs for the center tenants and 3 signs for the end tenants. He stated that they would ask that the PUD be amended to include the same signage for this site. Ms.McPherson explained that an amendment could not be considered as part of this request,due to publication and notification requirements and that the applicant would need to apply separately for an amendment to address signage. Mr.Tutt asked if the process for the conditional use permit could move forward and application for the amendment be made separately. Ms. McPherson stated yes. Mr.Harlicker asked for clarification on the exterior materials and colors. Mr.Tutt reviewed the materials and asked if colors needed to be chosen before the City Council consideration. Mr.Harlicker stated that this information should be submitted to staff by in time to be reviewed prior to the City Council meeting Commissioner Offerman asked how many signs are permitted in the PUD agreement. Ms. McPherson stated that one wall sign per tenant and one monument sign for the site is permitted. Commissioner Stevens stated that he felt the site was unique in that the majority of the traffic would approach the site from the rear. He felt there should be a better way to present the building on three sides. Commissioner Offerman stated that he shared Commissioner Steven's concerns and felt that additional signage and building materials could be used to improve the building's appearance on the three sides of the building.
