Sand Companies, Inc.

366 South lOth Avenue · PO Box 727 ° Waite Park, MN 56387-0727 ° Office (320) 202-3100 · Fax (320) 202-3139

August 6, 1998

Mayor Hank Duitsman & Council Members
City of Elk River
13065 Orono Parkway
Elk River, MN 55330

Country Irm & Suites Hotel
Elk River, MN

Honorable Mayor Duitsman and Council Members:

I am one of the owners of the new proposed Country Inn & Suites hotel on the site north
of Perkins on Hwy. 169. I am writing this letter to appeal to your sense of fairness and to
ask for some minor changes to the July 28th Planning Commission's approval of our
project in Elk River. At this meeting Sand Companies, Inc. was willing to compromise on
several issues but tried to make it clear that the proposed signs requirements are not
acceptable and that some of the other requirements will add significant costs to this
project. I certainly understand the need to compromise, however we felt that there was no
willingness to compromise on the City's part. We would like you to address the following
concerns at your August 17th COunCil meeting:

1.)

Twenty (20) foot trail easement. - The City requested a 20' easement on the north side
of our property. We are willing to grant this easement entirely on our property as
requested provided that no cost for this trail be assessed to our property. I believe
that this is a significant compromise on our part given the fact that the MNDOT
property should have been required to give 10' of the 20' and that this wffi allow the
City to complete the trail sooner at less cost.

2.)

Windows on the ends of the building. - Staff has requested windows on the ends of
our building, which none of the neighbors expressed any concern during the public
hearing and during our neighborhood meeting. This requirement will add unnecessary
costs and require significant redesigning of certain areas of our building. I would ask
to have this requirement waived as it seems to serve no significant purpose.

3.)

Freestanding sign requirements. - From the start of this process, we have made it very
clear to staff that there are some items we absolutely need in order for us to invest
$3.6 million into the community of Elk River and to be a successful hotel.
