County Road No. 33, which will require a driveway permit from Sherburne
County. The remaining 33 acres are farm fields and woods and would remain
as they are.

If the applicant wished to develop this property to its full potential, because
of the provision of 4 lots per 40 acres with a minimum lot size of 10 acres, it
might be possible to subdivide into 4 lots. However, at this time the applicant
is proposing to subdivide the property into 2 lots. Future subdivision will be
limited to 2 lots for a total of 4.

Both of the lots comply with the dimensional requirements of the A-1 district.
The site is in the A1 zone (Agricultural Conservation) across County Road 33
from the Rla zone (Single Family Residential).

Streets and Easements

County Road #33

Sherburne County Engineering Department was contacted regarding
additional right-of-way along County Road #33. They indicated that they
need a 50 foot right-of-way from the center line. The applicant's survey
shows a 50 foot right-of-way.

Easements

Drainage and utility easements will need to be provided along the property
lines of the 2.5 acre parcel. The applicant's survey shows a 10' drainage and
utility easement adjacent his property line.

Park and Recreation Commission Recommendation

The Park and Recreation Commission has recommended a cash dedication in
lieu of land to satisfy the park dedication requirements for the one new lot
being created.

Recommendation

Staff recommends that the City Council approve the request by Lee Whiting
for and an administrative subdivision to subdivide 43 acres into two lots with
the following conditions:

1. DRAINAGE AND UTILITY EASEMENTS BE GRANTED TO THE CITY ALONG
THE PROPERTY LINES OF THE PROPOSED 10 ACRE PARCEL.

\\elkriver~sys~shrdoc\planning\stevewen\ccmmo\as98-4.doc
