Staff is concerned that the relocation of the compliance boundary could allow a wider area of ground- <br /> water contamination to the west of the ERL and that groundwater contaminants are entering into the <br /> Rice Lake wetland complex and Tibbet's Brook. At some point,the MPCA, county, and city may require <br /> groundwater remediation work which could impact the accessibility of the trail. The MPCA suggested <br /> the city amend the December 28, 1992, agreement to allow the incorporation of the trail property inside <br /> the compliance boundary and allow for future corrective actions which may affect the trail property. <br /> Staff does not recommend this option. <br /> Lastly,unrelated to the comment letter,but concerning the draft permit, the Council approved a <br /> resolution on August 20, 2012, supporting prompt enforcement of Minnesota Statutes, Section, 473.848, <br /> Metro Wlaste Disposal Restrictions,restricting the disposal of unprocessed mixed municipal solid waste <br /> generated in the metropolitan area by landfill.
