the feasibility of corrective actions to maintain compliance with ground water quality standards at the <br /> compliance boundary; <br /> (d) <br /> the volume, composition, and physical and chemical characteristics of the leachate; <br /> (e) <br /> the proximity and withdrawal rates of ground water users, and the availability of alternative water <br /> supplies; and <br /> (f) <br /> any other public health, safety, and welfare effects. <br /> (2) <br /> The distance between the compliance boundary and the permitted waste boundary must be no greater <br /> than 200 feet.The commissioner may require a smaller separation distance if ground water flow rates <br /> are very slow or where necessary to provide additional protection to ground water, including sites with <br /> downward ground water flow. At existing facilities, including expansion areas,the commissioner may <br /> allow a separation distance greater than 200 feet if the following conditions are met: <br /> (a) <br /> the commissioner determines that the owner or operator has provided sufficient monitoring to assure <br /> reliable detection and tracking of pollutant migration within the area enclosed by the compliance <br /> boundary, and that the larger separation presents no greater risk to water quality and water use than a <br /> separation distance of 200 feet or less; <br /> (b) <br /> the hydrogeologic evaluation under subpart 3 is complete or will be completed according to a <br /> compliance schedule; and <br /> (c) <br /> the owner or operator revises the cost estimate for contingency action under part 7035.2615 to reflect <br /> any greater costs for additional monitoring;ground water containment, removal, and treatment; and <br /> other contingency actions, and provides evidence of financial assurance to pay for the increased costs. <br /> D. <br /> In addition to the compliance boundary required of all facilities under item C,the commissioner shall <br /> designate a lower compliance boundary at any facility where there is a potential for substantial <br /> pollutant migration downward to a deeper aquifer used locally as a source of water supply.
