Minnesota Administrative Rules <br /> 7035.2815 MIXED MUNICIPAL SOLID WASTE LAND DISPOSAL FACILITIES <br /> Subp. 4. <br /> Ground water performance standards. <br /> The owner or operator must design, construct, operate, and maintain the facility to achieve compliance <br /> with items A to J. <br /> A. <br /> A compliance boundary must be established at each facility in accordance with items B and C. If the <br /> conditions in item D or E apply, a lower compliance boundary and surface water compliance boundary <br /> may also be established. Ground water quality must comply with items E, F, and H at the locations given <br /> in item F. If an intervention limit established under items E, F, and H is exceeded in ground water at any <br /> location,the owner or operator must take the actions specified in item G. <br /> B. <br /> The owner or operator must propose the locations of the compliance boundary. The owner or operator <br /> shall submit the proposed locations to the commissioner for review and approval,together with the <br /> rationale for the selected locations, supporting information, and any additional information the <br /> commissioner may require to describe the locations of the boundaries in the facility permit. <br /> C. <br /> The compliance boundary must be established in accordance with subitems (1) and (2). <br /> (1) <br /> The compliance boundary must surround the waste fill area and leachate management system. It must <br /> be located on the facility property, with a sufficient setback from the property boundary to enable the <br /> installation of monitoring points and, if necessary,ground water control features. The following factors <br /> shall also be considered in establishing the location of the compliance boundary: <br /> (a) <br /> hydrogeologic factors, including attenuation and dilution characteristics; ground water quantity, quality, <br /> flow rates, and flow directions; and anticipated rates and directions of pollutant movement; <br /> (b) <br /> the feasibility of ground water monitoring at the compliance boundary; <br /> (c) <br />
