-CODE OF ORDINANCES <br /> Chapter 78- UTILITIES <br /> ARTICLE III. -SEWERS AND SEWAGE DISPOSAL <br /> DIVISION 2. -SEWER USE AND DISCHARGE REQUIREMENTS <br /> Subdivision II. - Building Sewers and Connections <br /> (1) Giving false information in connection with the application for a permit. <br /> (2) Incompetence of the permit holder. <br /> (3) Willful violation of any provisions of this division or any rule or regulation pertaining to the mixing <br /> of service connections. <br /> (Code 1982, § 1300.06(1)—(3), (16)) <br /> Sec. 78-122. - Payment of costs; indemnification of city. <br /> All costs and expenses incident to the installation and connection of the building sewer shall be <br /> borne wholly by the property owner. The owner shall indemnify and hold harmless the city from any loss <br /> or damage to the public sewer that may directly or indirectly be occasioned by the installation of the <br /> building sewer. After the initial connection to the main service stub, the property owner shall thereafter be <br /> liable for all maintenance and repairs to his sanitary sewer service line between the street main and the <br /> building being served. <br /> (Code 1982, § 1300.06(4)) <br /> Sec. 78-123. - Separate building sewer required for each building; exceptions. <br /> A separate and independent building sewer shall be provided for every building, except that where <br /> two or more buildings are situated on one parcel such that the parcel may not be subdivided, a single <br /> private sewer may be extended to the rear buildings and the whole considered as one joint use private <br /> sewer. Special variances will be considered by the city council. <br /> (Code 1982, § 1300.06(5)) <br /> Sec. 78-124. - Use of old building sewers. <br /> Old building sewers may be used in connection with new buildings only when they are found, on <br /> examination and test by a duly authorized city inspector, to meet all requirements of this division. <br /> (Code 1982, § 1300.06(6)) <br /> Sec. 78-125. - Filling of unused septic tanks and similar devices. <br /> Unused septic tanks, cesspools, leaching pits and similar devices and structures shall be backfilled <br /> or made safe and unusable in a manner acceptable to the city. <br /> (Code 1982, § 1300.06(7)) <br /> Sec. 78-126. - Materials and procedures for installation of building sewer. <br /> The size, slope, alignment, and materials of construction of a building sewer, and the method to be <br /> used in excavating, placing of pipe, jointing, testing and backfilling the trench, shall conform to the <br /> requirements of this Code and all other applicable rules and regulations. In the absence of Code <br /> provisions or in amplification thereof, materials and procedures set forth in appropriate specifications of <br /> Elk River, Minnesota, Code of Ordinances Page 13 <br />
