D. Rights of Review <br /> The City of Elk River and Elk River Municipal Utilities reserves the right to reject any or all <br /> proposals or to request additional information from any or all applicants as determined to be in <br /> the best interest of the City and ERMU. <br /> The City of Elk River and Elk River Municipal Utilities reserves the right, where it may serve the <br /> City of Elk River's and Elk River Municipal Utilities best interest, to request additional <br /> information or clarification from proposers or to allow corrections of errors or omissions. At <br /> the discretion of the City and ERMU, firms submitting proposals may be requested to make oral <br /> presentations as part of the evaluation process. Following a review of the proposals, a <br /> recommendation for award will be made by the Finance Director to the City Council and <br /> Utilities Commission. A final decision for award of the work will be made by majority vote of <br /> the City Council. <br /> The City of Elk River and Elk River Municipal Utilities reserves the right to retain all proposals <br /> submitted and to use any ideas in a proposal regardless of whether that proposal is selected. <br /> Submission of a proposal indicates acceptance by the proposing firm of the conditions <br /> contained in this request for proposal, unless clearly and specifically noted in the proposal <br /> submitted and confirmed in the letter of engagement between the City of Elk River and Elk <br /> River Municipal Utilities and the firm selected. <br /> E. Term of Engagement <br /> A five year engagement is contemplated, subject to annual review and renewal. Based on <br /> satisfactory performance, the concurrence of the City Council and Utilities Commission and the <br /> annual availability of an appropriation, the City and ERMU may extend the agreement annually <br /> without solicitations from other firms. In the event of unsatisfactory performance, or when in <br /> the best interest of the City and ERMU, proposals may be solicited before the end of the five <br /> year period. <br /> The agreement between the City of Elk River and Elk River Municipal Utilities and the insurance <br /> broker shall be in the form of a written contract. <br /> F. Subcontracting <br /> Following the award of the contract, no subcontracting will be allowed without the express <br /> prior written consent of the City and ERMU. <br /> II. INSTRUCTIONS <br /> A.
