REQUEST FOR ACTION <br /> River <br /> TO ITEM NUMBER <br /> City Council 7.2 <br /> AGENDA SECTION MEETING DATE PREPARED BY <br /> Public Hearings November 19,2012 Chris Leeseberg,Park Planner-Planner <br /> ITEM DESCRIPTION REVIEWED By <br /> Conditional Use Permit: Parey Farm LLC for Commercial Jeremy Barnhart,Planning Manager <br /> Boarding of Horses and Sale of Farm Products (21310 Brook REVIEWED BY <br /> Road NW), Case No. CU 12-22 <br /> ACTION REQUESTED <br /> Staff and the Planning Commission are recommending that the City Council approve the Conditional <br /> Use Permit (CUP) request with the conditions outlined: <br /> 1. As a Conditional Use Permit is not a Building Permit,the applicant shall apply for all <br /> required permits. <br /> 2. The building shall meet all building codes. <br /> 3. The building shall meet all fire codes. <br /> 4. All exterior signage shall require a permit. <br /> 5. Exterior signage shall not exceed six (6) square feet. <br /> 6. No more than 22 animal units shall be allowed on the property. <br /> 7. The Manure Management Plan shall be followed as recommended by the <br /> Environmental Administrator. <br /> 8. All manure (solid or liquid) shall be disposed of off-site in accordance with MPCA <br /> regulations. <br /> 9. If the city finds that the manure and other waste materials create a nuisance by <br /> attracting flies,other insects, rodents, or by creating offensive odors, the city may order <br /> that the manure and other waste materials be removed on a more frequent schedule. <br /> 10. A 50-foot vegetated buffer along wetlands is required. <br /> 11. The keeping of livestock(fences) must be set back at least five (5) feet from any property <br /> line. <br /> 12. Any use beyond horse boarding, retail sales of goat milk products or sustainable farm- <br /> crafted food goods will require an amendment to the Conditional Use Permit. <br /> 13. Goats under the age of six (6) months shall not be considered in the animal unit <br /> calculations. Birth records shall be provided upon request. <br /> PLANNING COMMISSION <br /> Only the applicants spoke during the public hearing and they questioned why the inside of the riding <br /> arena would not be considered pasture land,whether newborn goats be considered in the total number of <br /> animals,and asked for clarification of what was expected of them in regards of the manure management <br /> plan. <br /> Staff explained why the areas within buildings and on the gravel driveway/parking are not considered <br /> pasture land as they are not"fenced pasture land." <br /> EPONEIED <br /> D r <br /> N:\Departments\Community Development\Planning\Case Files\CUP\CU 12-22 Parey Farm LLC CU 12-22_CC.docx I!4ATLJPE <br />
