<br />CHAPTER 38, ARTICLE XI,
<br />REGARDING SPECIAL
<br />EVENTS, OF THE ELK
<br />RIVER, MINNESOTA, CITY
<br />CODE
<br />The City Council of the City of
<br />Elk River does hereby ordain as
<br />follows:
<br />Section 1. That the definition
<br />of "Special Event" set forth in
<br />Section 38 -512 of the City of
<br />Elk River Code of Ordinances
<br />shall be amended to read as
<br />follows:
<br />Special event means an out-
<br />door gathering, whether on
<br />public or private property, open
<br />to the public where at least 50
<br />individuals are expected to, or
<br />do, assemble with a common
<br />purpose for a period of one hour
<br />or longer. Special events
<br />include, but are not limited to,
<br />concerts, fairs, carnivals, cir-
<br />cuses, parades, flea markets,
<br />marathons, walkathons, festi-
<br />vals, races, bicycle events, cel-
<br />ebrations, or any other gath-
<br />ering or events of similar
<br />nature. Special events include
<br />private, noncommercial events
<br />such as graduation parties or
<br />social parties held on city prop-
<br />erty, regardless of the number
<br />of individuals in attendance,
<br />but does not include such
<br />events held on private prop-
<br />erty. 2. That Section 38 -516
<br />titled, Exceptions, of the City of
<br />Elk River Code of Ordinances
<br />shall be amended to add new,
<br />Section 38 -516 (a) (7), as fol-
<br />lows:
<br />(7) Non - commercial events
<br />held on park property for which
<br />a permit is required through
<br />the Parks and Recreation
<br />Department.
<br />Section 3. That this ordi-
<br />nance shall take effect upon
<br />adoption as provided by law.

<br />City Council of the City of Elk
<br />River this 18th day of
<br />June, 2012.
