Strilethretighs to be removed <br />Underlines to be added <br />• ORDINANCE 12- 09 <br />CITY OF ELK RIVER <br />AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING <br />CHAPTER 38, ARTICLE X1, REGARDING SPECIAL EVENTS, OF THE ELK <br />RIVER, MINNESOTA, CITY CODE <br />The City Council of the City of Elk River does hereby ordain as follows: <br />Section 1. That the definition of "Special Event" set forth in Section 38 -512 of <br />the Ciry of Elk River Code of Ordinances shall be amended to read as follows: <br />Special event means an outdoor gathering, whether on public or private property-, open to the <br />public where at least 50 individuals are expected to, or do, assemble with a common purpose <br />for a period of one hour or longer. Special events include, but are not limited to, concerts, <br />fairs, carnivals, circuses, parades, flea markets, marathons, walkathons, festivals, races, <br />bicycle events, celebrations, or an`- other gathering or events of similar nature. Special events <br />do net include private, noncommercial events such as graduation parties or social parties <br />held on city properm regardless of the number of individuals in attendance but does not <br />include such events held on private properm <br />• <br />Section 2. That Section 38 -516 titled, Exceptions, of the City of Elk River Code of <br />Ordinances shall be amended to add new Section 38 -516 (a) (7), as follows: <br />• <br />(7) Non - commercial events held on park Property for which a permit is required <br />through the Parks and Recreation Department <br />Section 3. That this ordinance shall take effect upon adoption as provided by law. <br />Passed and adopted by the City Council of the City of Elk River this 18th day of <br />June, 2012. <br />ti <br />Jo J.
