THE MOTION CARRIED 4-0. <br /> <br />Request by Dynamics Desiqn & Land Company for Preliminary Plat Approval <br />IBarsody Hills), Public Hearing Case No. P 98-2 <br /> <br />Staff report by Scott Harlicker. Dynamics Design & Land Company has requested <br />preliminary plat approval to subdivide 92 acres located on the north side of <br />County Road 12 and 217th Avenue alignment into 8 single family lots. An existing <br />farm will be made part of a 30 acre lot and an existing single family home will be <br />made pad of a 12 acre lot. Mining on the majority of the property is finished, <br />however, some small scale gravel mining will continue in the southwest corner of <br />the 30 acre parcel. Scott reviewed issued associated with the plat as outlined in <br />the staff report, including lot size averaging in the 10 acre zone and extension of <br />the roadway and septic systems. <br /> <br />Mayor Duitsman opened the public hearing. <br /> <br />Marion Glines, applicant, expressed his objection to. the requirement to provide <br />payment for Class V and bituminous for extension of the roadway to the property <br />line. Mr. Glines indicated it was his understanding that when the Planning <br />Commission recommended this condition, they only recommended grading and <br />seeding and did not recommend payment for Class V and bituminous. Mr. Glines <br />stated that future development of the property will be affected by mining on the <br />adjacent Shiely property. <br /> <br />Scott Harlicker explained that staff had verified this condition with Commissioner <br />Thompson, maker of the motion for recommendation to approve the plat. <br /> <br />Discussion followed regarding the requirement for a developer to bear the cost of <br />road improvements to the property line of plats. <br /> <br />Planning Commission Chair Tom Mesich indicated he would prefer that a land <br />trust be established for the 30 acre parcel to prevent any future subdivision of the <br />lot. <br /> <br />Councilmember Dietz asked if a letter of credit or some other means could be <br />used for extending the roadway, other than requiring the developer to pay cash. <br />City Engineer Terry Maurer explained that typically road construction to the end <br />of the plat is required and that, in lieu of this requirement, this payment option <br />should be considered part of the cost for developing the project. He stated that <br />the policy was implemented so that road improvement costs are covered by <br />developers and not the city regardless of whether the road is built in five years, or <br />ten years. <br /> <br /> <br />
