Conditional use permit to approve the development plans for the 20 <br /> townhomes and 80 assisted living units. Any commercial use of the <br /> property would have to be reviewed at a later date. <br /> <br />A variance to exceed the permitted density and allow an additional 6 <br />units be constructed as part of the assisted living facility. <br /> <br />Eo <br /> <br />A variance to exceed the maximum impervious lot coverage of 25% to <br />allow 30% impervious coverage to occur in tiers 3 and 3. <br /> <br />Variance Appealed <br /> <br />As the Council is aware, if the Board of Adjustments approves a variance <br />without there being any appeal to the decision, the variance does not need to <br />proceed to the City Council for any further action. On the other hand, if the <br />variance is denied, it is automatically appealed to the City Council. In this <br />particular case, two letters have been received appealing the Board of <br />Adjustments' decision. Guardian Angels is appealing the decision on the <br />variance regarding the impervious coverage. The second letter is from a <br />neighboring property owner who is also appealing the variance decision by <br />the Board. Therefore, even though the variances were approved by the <br />Board, the appeals require Council consideration. <br /> <br />Summa~. <br /> <br />Over the past year, numerous meetings involving City staff, Guardian Angels <br />and DNR representation have taken place to work through the project issues. <br />Given the Shoreland Ordinance implications on this property, the DNR has <br />been involved a great deal. Therefore, Larry Kramka from the DNR will be <br />in attendance Monday night to answer questions and help clarify some of the <br />Shoreland related issues. <br /> <br />Generally speaking, once the interpretation of the Shoreland Ordinance was <br />agreed upon, the townhome and assisted living portion of the project has <br />involved less controversy than the commercial. The commercial component <br />proposed at 43,000 square feet, exceeds the impervious coverage <br />requirements by almost 100% in tier 2 and about 70% in tier 3. This has <br />created the greatest challenge for everyone involved to make the commercial <br />fit. Depending upon the Council's decision on the variance relating to the <br />maximum impervious coverage, the plans may or may not have to be <br />modified. <br /> <br />s:\council\p97-12xl.doc <br /> <br /> <br />
