Elk River City Council Meeting <br />March 16. 1998 <br /> <br />Page 6 <br /> <br />lighting, noise, vandalism, litter, and trespassing. Jeff Asfahl updated the City <br />Council on the proposal to use the facility as a youth center. <br /> <br />Mayor Duitsman opened the public hearing. Mayor Duitsman indicated that he <br />would prefer to table any action on this issue so the issue could be further <br />discussed at a capital improvement meeting. <br /> <br />There being no fudher comments, Mayor Duitsman closed the public hearing. <br /> <br />Gary Santwire, representative of six building owners on Dodge Avenue, <br />indicated his concern that reasonable stipulations be considered when granting <br />the conditional use permit. Gary Santwire further recommended that a decision <br />on granting the conditional use permit be continued until there is a written <br />agreement on the table to lease the facility. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO POSTPONE ACTION ON THIS ITEM TO THE <br />APRIL 20, 1998, CITY COUNCIL MEETING. COUNCILMEMBER FARBER SECONDED <br />THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />6.5. Royal Oaks Realty Request for Final Plat - Riverplace, Case No. P 97-1 $ <br /> <br />City Planner Steve Ach indicated that Royal Oaks Realty has requested final plat <br />approval for Riverplace which consists of 59 single family lots, one outlot, and a <br />1.8 acre park located north of US Highway 10 along Queen Avenue alignment. <br /> <br />COUNCILMEMBER FARBER MOVED TO GRANT FINAL PLAT APPROVAL FOR ROYAL <br />OAKS REALTY. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. <br /> <br />A representative of Royal Oaks Realty indicated that he concurred with all of <br />the stipulations indicated in the memo with the exception of # 16 which requires <br />the developer to provide the city with some form of security to ensure that the <br />frontage road is built to an urban standard. He indicated that the road is a <br />county road and he did not feel the developer should be responsible for <br />rebuilding a county road. He requested that the Council not make a decision <br />at this time and continue this item until April. <br /> <br />Terry Maurer indicated that MnDOT recently turned the road over to the county <br />and the county was supposed to turn the road over to the city, however this did <br />not happen as of yet. <br /> <br />COUNCILMEMBER FARBER WITHDREW HIS MOTION. COUNCILMEMBER HOLMGREN <br />WITHDREW HIS SECOND. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO CONTINUE THIS ITEM TO APRIL 20, 1998. <br />COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />6.6. <br /> <br />Dynamics Desiqn and Land Company Request for Final Plat - Windsor Woods - <br />Case No. P 97-20 <br /> <br />City Planner Steve Ach indicated that Dynamics Design and Land Company has <br />requested final plat approval for Windsor Woods to subdivide approximately 71 <br />acres into 22 two and one-half acre single family lots located approximately ~ <br /> <br /> <br />
