Memo to Mayor and City Council/AS 97-9 January 20, 1998 Page 2 The proposed lot does not have any frontage directly onto a public road which is typically required as part of a subdivision. This lot does have access to the former Burlington Northern Railroad corridor which is now abandoned and owned by the City. Access to this property will be necessary on a limited basis to provide general maintenance and inspection of the facilities proposed to be constructed on the property. The main purpose of creating this lot is so the Elk River Municipal Utilities can own the property upon which their facilities will be located. Staff believes having frontage on a public road is a standard which could be waived due to the nature of the use of the property and the need to provide public facilities at a specific location to serve the area. As mentioned above access to the property will be along the City trail (former Burlington Northern Railroad corridor), therefore; when the trail is constructed from County Road No. 1 north to this parcel, the design standards should be increased to support maintenance vehicles that will have to use the corridor to access the property. There is also a lift station along this corridor that needs to be accessed for occasional maintenance. Recommendation It is recommended the City Council approve the administrative subdivision request by Elk River Municipal Utilities to create a 1.2_+ acre parcel for future construction of necessary utilities to serve this area of the community. It is recommended the following conditions be made part of the approval: Park dedication in the amount of $650.00 be paid prior to recording the administrative subdivision with Sherburne County. ge Surface Water Management Fee in the amount of $137.69 be paid prior to recording the administrative subdivision with Sherburne County. s:\council\as97-9.doc
