• Garden centers, which may include outdoor display <br />The following uses currently are allowed as conditional uses within the Project: <br />• Amusement and recreation uses <br />• Hotel and motels <br />• Licensed day caxe facilities <br />• Educational uses <br />• Motor vehicle service stations <br />• Motor vehicle specialty shops <br />• Car washes <br />• Restaurants (Class I and I1) <br />• On-sale liquor establishments <br />• Retail sale of gasoline <br />• Zero lot line development <br />In order to proceed with this CUP request, the applicant will have to amend the Elk River Crossing PUD. <br />Staff is recommending that the Elk River Crossing PUD agreement be amended to include language <br />allowing the leasing of moving/delivery trucks. <br />Although the applicant has not requested signage. Staff would not be opposed to adding the following <br />language to the Elk River Crossing PUD agreement: <br />Accessory to major tenant signage. One wall sign not to exceed 150 square feet. <br />RENTAL PROGRAM <br />The program is designed so a customer can rent a truck on-line or in the store. The truck will be brought <br />in from off site on the day of renter pick-up. The trucks can be returned to any participating Home <br />Depot or Penske location. Trucks will be taken away in a reasonable time frame upon drop off. <br />The applicant anticipates 2-6 trucks will be on site at any given time. They axe proposing parking stalls <br />for the 6 trucks in two different locations. One location would be for two trucks by the west entrance to <br />the property. The second location would be for four trucks near the north entrance into the building. <br />Staff has a concern with the two trucks parked by the entrance. Trucks parked there will act as signage, <br />especially at an entrance to a property. The city ordinance does not allow trucks to be utilized for the sole <br />purpose of advertising. Obviously the sole purpose of the trucks is not to advertise and they need to be <br />parked somewhere on site. Staff is recommending that all six trucks be located where they will not <br />compete with the parking for the main entrances to Home Depot, the retail building to the northwest, <br />Home Depot garden center, and where they will not be interpreted as signage. Staff is recommended the <br />six dedicated stalls be at the south end of the westerly outermost parking, as show on the site plan <br />(Exhibit A). <br />N:\Departments\Community Development\Planning\Case Files\CUP\CU 11-17 Home Depot\CU 11-17_PC.doc <br />
