Request by the Home Depot for a Conditional Use Permit to <br />operate Penske Truck Rental <br />Public Hearing -Case No. CU 11-17 <br />ACTION REQUESTED <br />There is a two action requested of the Planning Commission. <br />1. Staff recommends that the Planning Commission recommend approval of the Conditional Use Permit <br />(CUP) request to amend the PUD agreement to allow the rental of trucks as a conditional use at the Elk <br />River Crossing planned unit development. <br />2. Staff recommends the Planning Commission recommend approval of the Conditional use Permit <br />request to allow Penske truck rental with the following conditions: <br />1. The PUD agreement shall be amended to include language allowing the leasing of <br />moving/delivery trucks. Trucks not to exceed 26 feet. <br />2. Six dedicated parking stalls shall be provided at the south end of the westerly <br />outermost parking, as show on the site plan shown as exhibit A. <br />3. No more than six rental trucks shall be on site at any given time. No drive area may <br />be obstructed. <br />BACKGROUND/DISCUSSION. <br />The applicant is requesting to operate a Home Depot/Penske Truck Rental Program at the Home Depot <br />store. The property is part of the Elk River Crossing Planned Unit Development (PUD) and the <br />sale/rental of vehicles is currently not allowed as part of the PUD agreement. <br />The following uses are currently allowed as permitted uses within the project: <br />• Governmental, business and professional offices <br />• Retail shops and stores <br />• Personal service establishments <br />• Financial institutions <br />• Non-profit clubs, lodges or halls <br />• Veterinary clinics <br />P ®^ E i E® R <br />N:\Dcpartments\Community Development\Planning\Case Files\CUP\CU 11-17 Home Dcpot\CU 11-17_PC.doc <br />
