with the conditions and requirements of the City License shall be cause for revocation of this <br />Permit. <br />15.) Insurance and Bondine. Permittee shall provide such insurance, including workers <br />compensation insurance, and bonding as required in the City License. <br />16.) Applicability of Conditional Use Permit. Except as specifically provided otherwise in this <br />Permit, this Permit shall apply to the property described on Exhibit A ttached hereto. This Permit <br />shall run with the real property and apply to Permittee and its successors and assigns. <br />17.) Permit Period. <br />(Ol) This Permit shall not become effective until: <br />(a) Permittee has provided City with written documentation of Permittee's ownership <br />interest in all of the real property described on Exhibit A, attached hereto; <br />(b) Permittee has executed this Agreement for Issuance of Amended Conditional Use <br />Permit; and <br />(c) Permittee has executed a stipulation for dismissal of the case filed in Sherburne <br />County District Court, now known as ERL F the Appellants have withdrawn their <br />appeals to the Minnesota Court of Appeals in the matters known at ERL I, II and N; <br />and all parties to the ERL I, li, III and IV litigation have executed mutual releases of <br />all claims arising from that litigation. <br />(02) Once effective, this Permit shall be in force and effect for so long as the conditions set forth <br />herein are complied with, unless and until suspended or revoked as provided herein. <br />(03) Until this Permit becomes effective, the Existing CUP for the Landfill shall remain in <br />effect and no Landfill activities shall be permitted on any land not covered by the Existing CUP. <br />The Existing CUP shall automatically terminate on the date that this Permit becomes effective. <br />18.) Violation of Conditions. If the Permittee or its successors or assigns violates any term or <br />condition imposed by this Permit, or any solid waste facilities license issued for operation of the <br />Landfill, this Permit may be revoked and terminated. Without limifing the foregoing, the violation <br />of any statute, regulation, ordinance, permit or license condition imposed by lawful governmental <br />authority and governing operations on the Landfill Property is grounds for suspension, revocation <br />or termination of this Conditional Use Permit. The change, alteration, or amendment of any such <br />statute, regulation, ordinance, permit or license condition by any governmental authority other than <br />the City shall not excuse the Permittee from compliance with statutes, regulations, ordinances, <br />permit or license conditions in effect on the date of the original issuance of this Permit, unless <br />compliance is waived or excused by the City Council. The City shall not unreasonably refuse to <br />waive or excuse compliance with existing permit or license conditions. <br />CU_11-12 RH Page 7 <br />
