Consider the Resolution Initiatinq the Condemnation Process for Easement for the <br /> <br />Business Center Drive Expansion Project <br /> <br />City Engineer Terry Maurer explained that staff is requesting council consideration <br />to initiate condemnation proceedings for property owned by Mr. Bill Gagne. He <br />indicated that the city is interested in the property to obtain an easement for the <br />Business Center Drive improvements. <br /> <br />COUNCILMEMBER FARBER MOVED TO ADOPT RESOLUTION 97-133, RELATING TO <br />FINDING OF PUBLIC PURPOSE FOR THE ACQUISITION OF THE EASEMENT AND RIGHT- <br />OF-WAY FOR STREET AND UTILITY IMPROVEMENTS FOR BUSINESS CENTER DRIVE. <br />COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />4.5. Consider Ice Arena Commission Recommendation on Arena and Rink Names <br /> <br />4.6. <br /> <br />City Administrator Pat Klaers presented the entries for the "Name the Ice Arena <br />Contest." The Ice Arena Commission is recommending the following: that the <br />complex be named "Elk River Arena"; the old rink be named "The Barn"; and the <br />new rink be named "Olympic". <br /> <br />COUNCILMEMBER DIETZ MOVED TO APPROVE THE NAMES FOR THE ICE ARENA AS <br />RECOMMENDED BY THE ICE ARENA COMMISSION. COUNCILMEMBER THOMPSON <br />SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />Pat Klaers reviewed the proposed sign for the ice arena. Discussion took place <br />regarding the fact that the actual name of the arena is not proposed for the sign. <br /> <br />COUNCILMEMBER FARBER MOVED TO APPROVE THE SIGN FOR THE ELK RIVER ARENA <br />AS RECOMMENDED BY THE ICE ARENA COMMISSION. COUNCILMEMBER <br />HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />Update/Discussion on the Herita,qe Landin.q I and II Drainaqe Issue <br /> <br />City Administrator Pat Klaers reviewed this issue with the Council. He indicated <br />that the situation has not yet been resolved. Staff is recommending that the City <br />hire a contractor to do the drainage work in the easement area provided that <br />the developer pay or reimburse the city for the expense. <br /> <br />Dennis Chuba indicated that he would prefer the City to hire the work done due <br />to the potential for a law suit. He further stated that he did not feel that the <br />developer should be responsible for the payment of the work, but agreed to do <br />SO. <br /> <br />COUNCILMEMBER DIETZ MOVED TO HIRE "BIG JOHNS" TO CORRECT THE DRAINAGE <br />ISSUE AS INDICATED IN THE COUNCIL PACKET, PROVIDED THAT DENNIS CHUBA <br />SIGNS A LETI'ER INDICATING THAT HE WILL PAY THE CITY $3,050 FOR THE WORK <br /> <br /> <br />
