Council could supplement and/or adopt this resolution, or provide input to staff
regarding findings that should be included in a resolution for consideration at a future Council meeting.
BACKGROUND/DISCUSSION
Wapiti Park Campground, Inc. has requested renewal of a 3.2 Percent Malt On-Sale and 3.2 Percent Malt
Off-Sale liquor license. The city hasn't received the $225 fee for the 3.2 Percent Malt On-sale license. A
letter was sent to Ms. White on May 17, 2011 noting that the application was incomplete because the fee
has not been submitted.
Pursuant to Chapter G of the Elk River City Code regulating Alcoholic Beverages, 3.2 Percent On-Sale
and 3.2 Percent Off-Sale liquor licenses expire on June 30`'' of each year. Section 6-64 of the Elk River
City Code provides that the Council may, in its sole discretion and for any cause, refuse to grant any
application for a license under Chapter 6.
Although the issue before the City Council is renewal of the liquor licenses, not suspension or revocation,
Section 6-71 of the Elk River City Code provides that the City Council may suspend or revoke any license
for the sale of 3.2 Percent liquor upon finding that the licensee has failed to comply with any applicable
statute, regulation, or ordinance relating to the conduct of the licensee's business.
N:\Public Bodies\Ciry Council\Council RCA\Licensing\Liquor\2011\062011 Wapip Combined with PC Report.doc
