REQUEST FOR ACTION <br />TO ITEM NUMBER <br />Ci Council 6.2.B <br />AGENDA SECTION MEETING DATE PREPARED BY <br />Communi Develo ment une 20, 2011 Peter Beck, Ci Attorne <br />ITEM DESCRIPTION REVIEWED B~/ <br />Renewal of Wapiti Park Campground, Inc. 3.2 Percent On-Sale <br />and 3.2 Percent Off-Sale Liquor Licenses, Public Hearing REVIEWED BY <br />ACTION REQUESTED <br />Open public hearing <br />The Council is asked to open the public hearing to receive testimony and evidence from the applicant and <br />any other persons regarding whether the 3.2 Percent On-Sale and 3.2 Percent Off-Sale liquor licenses <br />should be renewed. <br />If the Council decides to renew <br />A motion would be needed approving the licenses to June 30, 2012. <br />If the Council decides not to renew <br />Attached is a draft resolution with proposed findings of fact regarding renewal of the liquor licenses for <br />Council consideration. Council could supplement and/or adopt this resolution, or provide input to staff <br />regarding findings that should be included in a resolution for consideration at a future Council meeting. <br />BACKGROUND/DISCUSSION <br />Wapiti Park Campground, Inc. has requested renewal of a 3.2 Percent Malt On-Sale and 3.2 Percent Malt <br />Off-Sale liquor license. The city hasn't received the $225 fee for the 3.2 Percent Malt On-sale license. A <br />letter was sent to Ms. White on May 17, 2011 noting that the application was incomplete because the fee <br />has not been submitted. <br />Pursuant to Chapter G of the Elk River City Code regulating Alcoholic Beverages, 3.2 Percent On-Sale <br />and 3.2 Percent Off-Sale liquor licenses expire on June 30`'' of each year. Section 6-64 of the Elk River <br />City Code provides that the Council may, in its sole discretion and for any cause, refuse to grant any <br />application for a license under Chapter 6. <br />Although the issue before the City Council is renewal of the liquor licenses, not suspension or revocation, <br />Section 6-71 of the Elk River City Code provides that the City Council may suspend or revoke any license <br />for the sale of 3.2 Percent liquor upon finding that the licensee has failed to comply with any applicable <br />statute, regulation, or ordinance relating to the conduct of the licensee's business. <br />N:\Public Bodies\Ciry Council\Council RCA\Licensing\Liquor\2011\062011 Wapip Combined with PC Report.doc <br />
