10MI11,14, <br />RESOLUTION NO. <br />RESOLUTION APPOINTING RESPONSIBLE <br />AUTHORITY FOR PURPOSES OF THE MINNE- <br />SOTA GOVERNMENT DATA PRACTICES ACT <br />WHEREAS, Minnesota Statutes, section 13.02, subdivision 16, as amended, requires that <br />the City of Elk River appoint one person as the Responsible Authority to administer the <br />requirements for collection, storage, use and dissemination of data on individuals, within the City; <br />and <br />WHEREAS, the City of Elk River shares the concern expressed by the legislature on the <br />responsible use of all City data and wishes to satisfy this concern by appointing an administrative- <br />ly qualified Responsible Authority as required under the statute; and <br />WHEREAS, the duties of Responsible Authority have in the past been performed by the <br />city administrator; and <br />WHEREAS, Patrick Klaers is the city administrator of the City. <br />1. The City Council of the City of Elk River appoints Patrick Klaers as Responsible <br />Authority for the purposes of meeting all requirements of the Minnesota Government Data <br />Practices Act, Minnesota Statutes, Chapter 13, as amended, and the rules lawfully promulgated <br />by the Commissioner of Administration at Minnesota Rules, Chapter 1205. <br />2. Mr. Klaers is authorized to delegate the duties of the Responsible Authority to <br />other City employees as Mr. Klaers, in his discretion, determines to be necessary in order to <br />satisfy the requirements of the Minnesota Government Data Practices Act and at the same time <br />continue to effectively and efficiently provide other City services. <br />This resolution becomes effective immediately upon its passage. <br />Adopted by the Elk River City Council on q_ '& a , 1997. <br />ATTEST. - <br />Sandra Thackeray, City Clerk <br />Hank Duitsman, Mayor <br />
