IA. Collecting Government Data, I <br />1. Government data "means all data created, collected, received, maintained, or disseminated <br />by any state agency, political subdivision or statewide system regardless of the data's physical <br />form, storage media or conditions of use." (Minn. Stat. § 13.07(7)) Government data includes <br />all papers, cards, correspondence, discs, maps, memoranda, microfilm, photographs, recordings, <br />reports, tapes, writings, computer medium and other data, information or documentary material. <br />(See Minn. Stat. § 138.17). <br />2. All public officers and agencies are required to keep all records necessary to a full and <br />accurate knowledge of their official activities (Minn. Stat. § 15.17). The Minnesota Government <br />Data Practices Act, (the "Act") states that a government agency can collect only information that <br />is necessary for the administration and management of programs specifically authorized by the <br />legislature, local governing body (i.e., city council, county board, etc.) or mandated by the federal <br />government. (Minn. Stat. § 13.05, subd. 3). This authorization is called the enabling authority, <br />Examples of "programs" are: building code enforcement, Community Block Development Grant <br />program, liquor licensing. All of these programs are established by and implement a federal, <br />state or local law. <br />3. The information that the City collects must be accurate, complete and current for the <br />purposes for which it was collected. At any time, a data subject may contest the accuracy and <br />completeness of the data the city maintains about him or her. Minn. Rules, Part 1205.1500 <br />defines the terms: <br />a. "Accurate" to mean that the data in question is reasonably correct and free from <br />error', <br />b. "Complete" to mean that the data in question reasonably reflects the history of an <br />individual's transactions with the particular entity. Omissions in an individual's history that place <br />an individual in a false light are not permitted; and <br />C. "Current" to mean that the data in question must be logically related to the entity's <br />required and actual use of the data in its day-to-day operations. (Minn.
