individuals to a person unless the requesting person provides reasonable assurance that the person <br />is entitled to access. "Reasonable assurance"' includes: <br />a. the requesting person appears at City offices and <br />(1) the Responsible Authority or designee knows and recognizes the person as <br />being the data subject or other person who by law is entitled to access; or <br />(2) presents identification showing him/her to be the data subject or other <br />person who by law is entitled to access; or <br />(3) presents identification showing him/her to be a person designated to have <br />access in an "Informed Consent" that meets the requirements of Section <br />5.B.; or <br />(4) in the case of private data on a minor or individual adjudged mentally <br />incompetent, presents identification showing him/her to be the parent of the <br />data subject or presents a copy of a court order appointing him/her as <br />guardian or conservator over the person or estate of the data subject; or <br />(5) in the case of data on decedents, present identification and documentation <br />showing him/her to be a representative of the decedent or trustee in a <br />wrongful death action. (See Section 2.C.) <br />MR <br />b. the request is sent by mail and: <br />(1) the Responsible Authority or designee knows and recognizes the data <br />subject's signature on the request; or <br />(2) the request is accompanied by an "Informed Consent" that meets the <br />requirements of Section 5.B.; or <br />(3) the Responsible Authority or designee verifies the signature on the request <br />as that of the data subject by comparing the signature to other City records <br />that contain the data subject's signature. <br />4. Government Access. <br />a. The Responsible Authority or designee may allow other government agencies to <br />have access to private data on individuals or nonpublic data not on individuals <br />only when the access is authorized or required by statute or federal law.
