IA. Requests for Data - General I <br />This section establishes procedures for handling requests for access to and copies of government <br />data. Generally, individual data subjects and persons other than data subjects have the following <br />rights-, <br />a. Upon request to a Responsible Authority, an individual must be informed whether <br />the individual is the subject of stored data on individuals and whether the data is <br />classified as public, private, or confidential. An individual data subject has the <br />right to inspect and copy public or private data of which s/he is the subject and <br />to be informed of the data's meaning. (Minn. Stat. § 13.04, subd. 3) <br />b. Any person has the right to inspect and copy public data, regardless of the <br />person's interest in the data. Upon request, any person requesting data has the <br />right to be informed of the data's meaning. (Minn. Stat. § 13.03, subd. 3; Minn. <br />Rules, Pt. 1205.0300, subp. 2) <br />IB. Requests for Public Data <br />1. Scope, This Section 7.13 applies to all requests for public data except: <br />a. requests for Summary Data. See Section 6, "Summary Data"; and <br />b. requests for public data that is related to or requested by a party in litigation with <br />the City or that is requested by subpoena. See Section TE. <br />2. Hours. Requests for access to public data must be made during normal business hours. <br />(Minn. Rules, Pt. 1205.0300, subp. 3) <br />3. Who May Have Access. The Responsible Authority or designee must provide access <br />to public data to any individual or entity who requests the data, without regard to the nature of <br />that person's interest in the data. Access includes the right to inspect the data or to obtain copies. <br />(Minn. Stat. § 13.03, subd. 3; Minn. Rules, Pt. 1205.0300, subp. 2) <br />NOTE: A person who requests public data is not required to provide his or her name, <br />address or other identifying information, and is not required to state his or her reason for <br />requesting the data. <br />CAH50884 <br />GA115-26 29 <br />
