d. specific as to the nature of the information s/he is authorizing to be disclosed; <br />e. specific as to the persons or entities to whom s/he is authorizing information to be <br />disclosed; <br />f. specific as to the purpose or purposes for which the information may be used by <br />any of the parties named in clause (c), both at the time of the disclosure and at <br />any time in the future; <br />9. specific as to its expiration date which should be within a reasonable period of <br />time, not to exceed one year except in the case of authorizations given in <br />connection with applications for life insurance or non -cancelable or guaranteed <br />renewable health insurance and identified as such, two years after the date of the <br />policy. (Minn. Stat. § 13.05, subd. 4(d); Minn. Rules, Pt. 1205.1400, subp. 5) <br />6. An example of an "Informed Consent" form is contained in Exhibit F. <br />IC. Implied Consent <br />1. The Responsible Authority may deem informed consent to have been given, even in the <br />absence of a written consent signed by the data subject, under the following limited <br />circumstances: <br />a. informed consent is needed to authorize a new or different use of the data by the <br />City; and <br />b. the Responsible Authority or designee has made reasonable efforts to obtain the <br />informed consent of the data subject but those efforts are not acknowledged in any <br />way. (Minn. Stat. § 13.05, subd. 4 (d); Minn. Rules, Pt. 1205.1400, subp. 4.C.) <br />2. "Reasonable efforts" means: <br />a. depositing in the United States mail, postage prepaid and directed to the last <br />known address of the data subject, at least two communications requesting <br />informed consent; and <br />b. waiting for a period of not less than 60 days for a response to the second request. <br />(Minn. Stat. § 13.05, subd. 4 (d); Minn. Rules, Pt. 1205.1400, subp. 4.C.) <br />3. Upon the expiration of the 60 day period, the Responsible Authority may interpret the <br />silence of the data subject <br />ject as the giving of an implied consent to the new or different purpose or <br />use of the data, and the Responsible Authority may implement the new or different purpose or <br />use as though a signed consent had been received.
