IB. Requirements for Informed Consent <br />1. All informed consents must be in writing on a form provided by the City and approved <br />by the Responsible Authority. The informed consent form must describe the necessity for or <br />consequences of the giving of informed consent, including the consequences of the new or <br />different purpose or use of the data. Informed consents that are not on a City form may be <br />accepted if the Responsible Authority determines that the consent provided is substantially similar <br />to a City informed consent form. <br />2. An informed consent must be signed by the individual data subject or, in the case of a <br />minor or a person adjudged mentally incompetent, by the data subject's parent or guardian or, <br />in the absence of a parent or guardian, by the person acting as the parent or guardian. (Minn. <br />Stat. § 13.02, subd. 8) <br />3. For data security reasons, the signature: of the data subject should be witnessed. If the <br />signature is not witnessed, the Responsible Authority or designee must make reasonable attempts <br />to verify the signature as belonging to the data subject. Reasonable attempts at verification <br />include: <br />a. the Responsible Authority or designee knows and recognizes the data subject's <br />signature; or <br />b. the Responsible Authority or designee compares the signature on the "Informed <br />Consent" to other City records that contain the data subject's signature; or <br />C, the Responsible Authority telephones the data subject, and the data subject <br />confirms that s/he signed the "Informed Consent"; or <br />d. the data subject personally appears before the Responsible Authority or designee, <br />presents identification, and either signs the "Informed Consent" or verbally <br />confirms that the signature on the "Informed Consent" is his/hers. <br />4. No City employee shall take any action to coerce any data subject to give an informed <br />consent. (Minn. Rules, Pt. 1205.1400, subp. 4.A.) <br />5. Informed consent shall not be deemed to have been given by an individual subject of the <br />data by the signing of any statement authorizing any entity or person to disclose information <br />about him or her to an insurer or its authorized representative, unless the statement is: <br />a. in plain language; <br />b. dated; <br />C. specific in designating the particular persons or agencies the data subject is <br />authorizing to disclose information about him or her; <br />CAH50684 <br />GA115-26 23 <br />
