4. Expiration of Classification. Except for security information, nonpublic data shall <br />become public 10 years after the data was created, collected or received by the government <br />agency. However, if the Responsible Authority determines that harm to the public or to a data <br />subject outweighs the benefit to the public, then the Responsible Authority may deny access. The <br />requester may seek court action. (Minn. Stat. § 13.03, subd. 8) <br />I. Protected Nonpublic Data Not on Individuals. <br />1. Definition. Protected nonpublic data not on individuals means data which is not public <br />and not accessible to the subject of the data. (Minn. Stat. § 13.02, subd. 13) <br />2. Data Not on Individuals Is Protected Nonpublic If: <br />a. A state statute or federal law classifies the data as not accessible to the public and <br />not accessible to the data subject. (Minn. Stat. § 13.02, subd. 13) <br />b. A "Temporary Classification" of government data as protected nonpublic has been <br />approved by the Commissioner of Administration and has not expired or been <br />disapproved by the Attorney General. (Minn. Stat, § 13.06) <br />3. Access. Protected nonpublic data not on individuals is accessible to: <br />a. Personnel within the entity whose work assignment reasonably requires access, as <br />determined by the Responsible Authority or designee. <br />b. Individuals, entities or persons authorized by statute or federal law to gain access. <br />C. A court, pursuant to a court order. <br />d. Individuals, entitles or persons as otherwise provided for by law. <br />4. Expiration of Classification.
