d. Individuals or agencies specifically authorized access to the data by a state, local <br />or federal law enacted after collection of the data. (Minn. Stat. § 13.05, subd. <br />4(b)) <br />e. Individuals, entities or persons subsequent to the collection of the data when <br />specifically approved by the Commissioner of Administration as necessary to carry <br />out a function assigned by law. (See Section 4.A.5.) (Minn. Stat. § 13.03, subd. <br />f. A court, pursuant to a court order. (Minn. Stat. §§ 13.10; 13.03, subds. 4 and 6) <br />4. Expiration of Classification. Confidential data on decedents is public 10 years after the <br />actual or presumed death of a data subject and 30 years after the creation of the data. <br />An individual is presumed to be dead 90 years after the creation of the data or 90 years <br />since the individual's birth, whichever is earlier, unless there is readily available data that the data <br />subject is still living. (Minn, Stat. § 13. 10, subd. 2) <br />F. Summary Data <br />1. Definition. Summary data means statistical records and reports derived from data on <br />individuals but in which the individuals are not in any way identifiable. (Minn. Stat. § 13.02, <br />subd. 19) <br />2. Data Is Summary If - <br />a. All data elements that could link the data to a specific individual have been <br />removed, and <br />b. Any list of numbers or other data which could uniquely identify an individual is <br />separated from the summary data and is not available to persons who gain access <br />to or possess summary data. (Minn. Rules, Pt. 1205.0200, subd. 16) <br />1 Access. Unless classified by a "Temporary Classification", another statute or federal law, <br />summary data is public and may be requested by and made available to any individual or person. <br />(Minn. Stat. § 13.05, subd. 7) <br />Note: Further information regarding requests for summary data is contained in Section 6. <br />IG. Public Data Not on Individuals I <br />1. Definition.
