4. Evidence of Death. Evidence of death may include but is not limited to: <br />a. The death certificate or copy; <br />b. A publication of death (e.g., obituary in the local newspaper); or <br />C. Funeral card. <br />5. Representative of the Decedent. <br />a. The "representative of the decedent" is: <br />(1) The personal representative of the estate during the period of <br />administration; <br />(2) If there is no personal representative of the estate or after discharge of the <br />personal representative, the spouse or any child of the decedent or, if there <br />is no surviving spouse or children, the parents of the decedent. (Minn. <br />Stat. § 13.10, subd. l(c)) <br />b. Documentation of the representative of the decedent may include: <br />(1) Letters of administration appointing the individual as the administrator of <br />the estate. <br />(2) Any documentation that establishes kinship. This may include but is not <br />limited to birth certificate, death certificate, baptism record, school records, <br />marriage license, church records, military record, social security record, <br />probate record, adoption record, divorce records and immigration records. <br />C. Rights conferred on subjects of private and confidential data shall be exercised by <br />the representative of the decedent. Many of these rights are contained in Exhibit <br />A. <br />6. Expiration of Classification. Private data on decedents is public 10 years after the actual <br />or presumed death of the data subject and 30, years after the creation of the data. <br />An individual is presumed to be dead 90 years after the creation of the data or 90 years <br />since the individual's birth, whichever is earlier, unless there is readily available data to indicate <br />that the data subject is still living. (Minn. Stat. § 13.10, subd. 2) <br />D. Confidential Data on Individuals. <br />1. Definition. Data on individuals is confidential if it is made by statute or federal law not <br />accessible by the public and not accessible to the individual subject of the data. (Minn.
