RESOLUTION 07-OS <br />A RESOLUTION FOR THE CITY OF ELK RIVER <br />A RESOLUTION SUPPORTING AND AGREEING TO MAINTAIN <br />GREAT NORTHERN TRAIL ENHANCEMENT PROJECT <br />Resolution of uPport from Sponsoring enck <br />BE IT RESOLVED that the City of Ells River act as sponsoring agency fora "Transportation <br />Enhancements" projett identified as Great Northern Trail (CS_AH 33 to North City Limits) <br />and acknowledges herewith that it is willing to be the project sponsor, knowing full well that <br />such sponsorship includes a willingness to secure and guazantee the local shaze of costs <br />associated with this project and responsibility fox seeing this project through to its <br />completion, with compliance of all applicable laws, Hiles and regulations. <br />BE IT FURTHER RESOLVED that Terry Mauler, Ell; River City Engineer is hereby authorized to act as <br />agent on behalf of this application. <br />Agreement to Maintain Facilirv <br />WHEREAS, The Federal Highway Adnvnistration (FHWA) requires that states agrees to operate and <br />maintain faalities construtted with federal transportation funds for the useful life of the improvement and <br />not change the use of right of way acquired wdthout poor approval from the FHR/A; and <br />WHEREAS, Transportation enhancement projects receive fedetal funding from the Surface <br />Transportation Program (STP) of the Transportation Equity Act A Legacy for Users (SAFETE.A-LU); and <br />WHEREAS, City of Elk River is the project sponsor for the transportation enhancement Project <br />identified as Great Northern Trail (CSAH 33 to North City Limits). <br />THEREFORE, BE IT RESOLVED THAT the Project Sponsor hereby agrees to assume full <br />responsibility for assuring the operation and maintenance of propertc and facilities related to the <br />aforementioned transportation enhancement project will be faithfully executed by the appropriate responsible <br />parties. <br />Certification <br />I hereby certify that the foregoing resolution is a true and coaect copy of a resolution adopted by City of Elk <br />River on this 8~ day of January, ?007. <br />SIGNED: <br />Steph ~ 'e A.
