Resolution Accepting Bid and Authorizing <br />Execution of Contract <br />Action Requested <br />The City Council is asked to conduct an improvement and assessment public hearing for the 2010 Main <br />Street Pavement Rehabilitation Project. After the hearings axe closed, the Council is requested to <br />consider adoption of three resolutions: The first, ordering the improvement; the second adopting the <br />assessment roll; and the third, accepting the bid and authorizing execution of the contract. <br />Background/Discussion <br />The City Council authorized and subsequently received the Feasibility Study for this project. The <br />Feasibility Study found the project to be necessary and feasible. As the project was initiated by the City <br />Council, the resolution ordering the improvement is required to pass by a 4/5 vote. <br />The project is proposed to be assessed to the benefiting properties. As requested an assessment roll has <br />been prepared which includes those properties served by Main Street. Properties previously assessed for <br />street work, excluding the 1988 reconstruction of Main Street, have not been included as directed by the <br />City Council. Residential properties are assessed one unit per parcel, except those parcels that are <br />adjacent to the principle structure and the same owner. Commercial properties are assessed at two units <br />per parcel and condominium or apartment parcels are assessed one quarter unit per parcel. A total of 85 <br />units are included in the proposed assessment roll. <br />As the City Council is aware, assessed property owners have the right to appeal the assessment of this <br />project against their property. In order to preserve their rights to appeal the assessment, the property <br />owner must submit in writing an objection to the Mayor or City Administrator at or before the <br />assessment hearing Monday evening. A property owner simply orally making a statement at the <br />assessment hearing does not preserve the owner's right to appeal. As of the date of this memo, staff has <br />received no written objections to the proposed assessment. <br />As directed by the City Council the project was advertised for bid. Bids were opened on June 1, 2010. A <br />total of five bids were received with Ruin River Contracting submitting the lowest bid in the amount of <br />$443,874.70. Rum River Contracting has completed a number of projects for the City of Elk River. Staff <br />recommends award of the contract to Rum River Contracting of Princeton, Minnesota. <br />
