Beginning this Fall would likely <br />allow sufficient progress on these items so that building permits could be issued by the <br />end of July, 2002. If grading cannot begin this Fall, then the earliest permits might be <br />available is November, 2002. Worse, a little bad luck with weather with a Spring, 2002 <br />start could mean no buildings permits until Spring, 2003. This is a hardship which can be <br />avoided by this modified waiver request. D.R. Horton Company would post the usual <br />city-required performance security for the grading, drainage and erosion control prior to <br />its commencement of any grading activities. <br /> <br />As the report from Michele McPherson, Director of Planning, dated August 28, 2001, <br />points out, our request for Trott Brook Farms South is well within the density range of <br />medium density residential in the City's Comprehensive Plan. Thus, while important <br />details of the townhome area's site plan may be affected by the pending R-3 zoning <br />ordinance, the City's Comprehensive Plan recognizes this area as appropriate for our <br />contemplated land use type. We will take the risk as to the final form of the ordinance, <br />and participate in discussions regarding its content. <br /> <br />With respect to the 19 single family lots, the smallest is 12,800 square feet and the largest <br />is 19,520 square feet. The smallest lot size, of which there are eight, exceeds by 800 <br />square feet the minimum lot size in the proposed R-3 ordinance. <br /> <br />In sum, we see no measurable risk to the City in this approach. Whatever real risk exists <br />with respect to the ultimate outcome of the discussions regarding the R-3 zoning <br />classification resides with D.R. Horton Company. However, being able to commence <br />grading and utility installation this Fall avoids a substantial hardship and is a significant <br />advantage for D.R.
