Horton Company has requested a waiver of the townhome moratorium, and <br />approval of rezoning, preliminary plat and conditional use permit for Trott Brook Farms <br />South. The Planning Commission has recommended denial of our requests. <br /> <br />This letter explains our modification to the initial request. As modified, we hope that you <br />agree that there is no risk to the City to approve the modified request. <br /> <br />Our modified waiver request is as follows: <br /> <br />Approve the PUD rezoning and preliminary plat to allow for the streets <br />and the detached single family home lots only. All of the townhome area <br />would be platted solely as outlots. <br /> <br />Rezoning and conditional use permit for the townhome area outlots and <br />associated final plats would occur only after the City completes its <br />deliberations on the proposed new R-3 zoning. <br /> <br />In this manner, the City has made no commitment of any sort with respect to the number, <br />configuration, type of unit, open space, etc. as to any portion of the townhome area. All <br />of the risk regarding ordinance changes affecting the development of the townhome <br />outlots rests with D.R. Horton Company. <br /> <br />On the other hand, the benefit to D.R. Horton Company if you approve the modified <br />waiver is that this Fall it may commence grading the entire site and construction of the <br /> <br /> <br />
