ity of ' <br />River <br />FROM: <br />DATE: <br />MEMORANDUM <br />Mayor and City Council <br />Sandra Thackeray, City Clerk <br />November 20, 1995 <br />ITEM 5.12. <br />SUBJECT: Consider Adoption of Drug and Alcohol <br />Policy for Drivers of Commercial <br />Vehicles <br />ATTACHMENTS. <br />• Employee Drug and Alcohol Policy for Drivers of Commercial <br />Vehicles <br />• Section 218.08(6) of the Elk River City Code relating to employee <br />discipline <br />• INTRODUCTION. <br />The Federal Regulations require that cities with less than 50 commercial <br />drivers adopt a drug and alcohol policy for commercial drivers by January 1, <br />1996. The City has presented a draft policy for Council review. <br />BACKGROUND: <br />The attached Drug and Alcohol Policy has been reviewed by Attorney Dayle <br />Nolan of Larkin, Hoffman, Daly and Lindgren. The proposed policy explains <br />the city's program in detail; i.e. procedures for testing, consequences of <br />positive tests, etc. The information in this policy is required to be provided to <br />the drivers. <br />Most of the information in the Drug and Alcohol Policy is required by federal <br />regulations, therefore, there is not much room for deviation. The area that <br />does provide the City some discretion relates to consequences to drivers <br />engaging in prohibited conduct. <br />It is the recommendation of the City's Attorney, Peter Beck to have any <br />disciplinary action consistent with the City's Personnel Ordinance. <br />13065 Orono Parkway • P.O.
