Drug and Alcohol Policy Memo <br />November 20, 1995 <br />Page 2 <br />---------------------------------------------- <br />• Therefore, the City's draft policy refers to the personnel section of the City <br />Code in relation to discipline for those drivers who test positive for either <br />drugs or alcohol. Section 9, Pages 10 -12 of the attached drug and alcohol <br />policy discusses consequences to drivers engaging in prohibited conduct. <br />FIRST POSITIVE TEST... <br />In the City's policy, an employee who tests positive for either drugs or alcohol <br />for the first time is subject to discipline but not subject to discharge <br />provided that the driver follows the advice of the Substance Abuse <br />Professional (SAP) (Page 11, #3 of policy). <br />Following a positive test, the SAP will evaluate what assistance, if any, the <br />driver needs in resolving problems associated with alcohol or drug abuse. If <br />it is determined that the driver has a chemical dependency or abuse problem, <br />the SAP will recommend that the driver participate in an appropriate <br />program. Any costs associated with the program will be incurred by the <br />driver. Also, if the driver is unable to return to duty due to the <br />recommendation of the SAP, he /she must use accumulated vacation or sick <br />• leave. If there is no vacation or sick leave available, the driver will be placed <br />on an unpaid medical leave of absence. The driver will be required to follow <br />the recommendations of the SAP, or else he /she will be subject to termination <br />of employment with the City. (Page 11, #4 of policy) <br />SECOND POSITIVE TEST... <br />A driver who receives a second positive test within a five year time period is <br />subject to discipline as indicated in the City's personnel ordinance. This <br />discipline does include possible termination. The measure of discipline <br />would be left to the discretion of the City Council. (Page 11, #4, of policy). <br />REFUSE TO TEST... <br />A driver who refuses to submit to the required drug or alcohol test is subject <br />to disciplinary action, including termination of employment as indicated in <br />the City's personnel ordinance. <br />• <br />
