RE: Elk River I~ea.r Terry: You requested that I advise you on the process and time required to secure easements for a sewEr at~d water n~an pro}ect in Elk River. The procedure we follow is based on the Federal Uniform Relocation and Acquisition Act wlairh is adc-~atecl by Minnesota. Statutes and Minnesota State Aid Procedures (MSA). The -first :step in the process is of course the survey and preparation of the descriptions. This would lie yslur resp~~ns-btlfty. After the descriptions are prepared the takings need to be valued. Depending on the sire and vah~e of tlae tak:irgs, tl-is could take up to four weeks. The review appraisal would take two weeks. t~'ltile the valuation is in process a preliminary title search is done. This verifies the owners arad ;any encaarnbrances. The necessary documents are also prepared. These activities go on simultaneously. After the valuation process is completed an "offer letter" with Just Compensation vah~e is prepared for the City's execution. This process takes abou# one week. At dais point negotiations begin. The offer letter and landowner pamphlets are given to each owner, 'I'lae arnount o!rtinte allocated to negotiations is dictated by the date constriction needs to begin. If negotiations are not successful on some parcels, condemnation may be necessary. To secure right of entry, this process could require 120 to 150 days, using the "quick take process". The right to enter arty property under condemnation is not granted until ninety days after filing the petition.
