City

MEMORANDUM

Item # 6. I.

TO:

FROM:

Mayor and City Co~cil ~

Michele McPhersdl~_~Director

of Planning

DATE:

March I I, 2002

SUBJECT: Request by Mike Jones for Variance - Case No. V 01-08

Attachments

March 6, 2002 Memorandum from Peter Beck, City Attorney
Resolution 02-
· January 22, 2002 City Council Minutes
· Staff report

Analysis

Per the City Council's direction on January 22, 2002 the City Attorney has reviewed the
request by Mike Jones to allow slopes greater than 3:1 without a retaining wall. As Mr. Beck
points out in his memo, it is possible for the City Council to grant the variance with
conditions. He recommends that the Council approve a detailed resolution (attached) for
which outlines the conditions that must be met. The resolution would be recorded against
the property with the variance action.

The Council may want to change the resolution as the time lines contained within are
relatively short and only allows one growing season for the establishment of the vegetation.

Recommendation

The Board of Adjustments and staff have recommended that the Council deny the variance
request. If the resolution addresses the concerns of the Council to grant the variance, staff
recommends that the City Council adopt the resolution, require the applicant to sign it, and
authorize staff to record it with the variance action against the property.

S:\PLANNING\Case Files\V 01-08 Jones\3-11StaffReport.doc
