The request from the City was to allow the City to outlet
water into the County ditch system. The City requested to put storm drainage water from
the Main and Evans intersection into County Ditch 10 on the west side of Highway 169.
This outlet is just south of Main Street, near the Earl Hohlen property.

The City also requested permission to outlet water into County Ditch 10 on the east side
of Highway 169, south of County Road 12. This outlet of water into the County ditch
system would also be near some Earl Hohlen property.

e

As the Council may reciill, plans are moving forward for an improvement project between
County Road 12 and 13 (east of Highway 169) to eliminate water problems in this part of
the City. In fact, bids have been awarded contingent upon approval from the County to
outlet water into Ditch 10. Both parts of Ditch 10 on the east and the west sides of
Highway 169 outlet into the new culverts that the City partially financed underneath the
reconstructed Highway 101/1 0/169 intersection.

No decision was made on 1/17/95 by the County Ditch Authority on the City's request.
A decision is expected at the 2/21/95 County Ditch Authority meeting. The City
Attorney will be in attendance at this City Council meeting on 1/23/95 in order to update
the Council on the status of our petition for outletting water into Ditch 10. Additionally,
the City Attorney has been working with the County Attorney and our local legislators in
order to pursue state legislation that would allow the City, under certain conditions, to
take over County ditches.

s/council/ditchlO

e

13065 Orono Parkway.
