RESOLUTION 99- 9 <br /> <br /> A RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br /> A RESOLUTION OF THE CITY OF ELK RIVER <br />AUTHORIZING THE CLOSING OF THE RAILROAD CROSSING ON <br />173RD AVENUE AND THE PRIVATE CROSSING SOUTH OF 171sT AVENUE <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br /> the City has worked with Burlington Northern and Santa Fe Railway to approve a <br /> new railroad crossing at 171st Avenue; and <br /> <br /> Burlington Northern and Santa Fe Railway has made the opening of the new <br /> crossing at 171st Avenue contingent upon closing the existing railroad crossing <br /> on 173rd Avenue and private crossing south of 171st Avenue; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: <br /> <br />1. At the time that the 171st Avenue railroad crossing is opened to traffic both the 173r~ <br /> Avenue crossing and the private crossing south of 171st Avenue shall be closed and the <br /> easement for the 173ra Avenue crossing within the railroad right-of-way shall be vacated. <br /> <br />Passed and adopted this 16th day of February, 1999. <br /> <br />Steph~t~hie A.
