______________________________________________________________________________ <br /> <br />Page 1 of 1 <br /> <br /> <br /> <br /> <br /> <br />UTILITIES COMMISSION MEETING <br /> <br />TO: <br />ERMU Commission <br />FROM: <br />Mark Hanson – General Manager <br />MEETING DATE: <br />May 13, 2025 <br />AGENDA ITEM NUMBER: <br />4.2 <br />SUBJECT: <br />ERMU Commission Eligibility Requirements <br />ACTION REQUESTED: <br />Determine Eligibility Requirements for ERMU Commission Membership <br /> <br />BACKGROUND: <br />On June 3, 2024, the City Council adopted City Ordinance 24-14 - Amending Chapter 2, Article <br />V, Boards and Commissions of the City of Elk River, Minnesota, City Code, which includes a <br />provision that all City of Elk River commissions will review their bylaws annually. ERMU’s bylaws <br />were reviewed at the March 11, 2025, commission meeting. Since that time, however, City staff <br />have identified an oversight regarding ERMU commission member eligibility requirements as <br />updated by Ordinance 24-14. <br /> <br />During the update of the ordinance, eligibility requirements for the various city commissions <br />were removed from city ordinance as part of an effort to shift meeting requirements to the <br />respective commission/board’s bylaws. <br /> <br />DISCUSSION: <br />Since ERMU’s commission receives delegated authority from the City Council, best practice is to <br />put commission eligibility requirements in city ordinance. In discussing next steps with City <br />Administrator Cal Portner, it was determined the best course of action is to first discuss <br />eligibility requirements with ERMU commission members, then bring proposed updates to the <br />City Council for consideration when they revise the ordinance. The following ordinance <br />requirements should be considered for implementation: <br />• All Commissioners shall be ERMU customers, <br />• Up to two commissioners may be City of Elk River Councilmembers, <br />• At least one, preferably two, commissioner(s) shall be ERMU water customers, and <br />• Up to one commissioner may live outside of Elk River city limits. <br /> <br />ERMU’s bylaws are attached for review. <br /> <br />ATTACHMENTS: <br />• ERMU Policy – G.1a – Bylaws <br />67
