______________________________________________________________________________ Page 1 of 1 UTILITIES COMMISSION MEETING TO: ERMU Commission FROM: Mark Hanson – General Manager MEETING DATE: May 13, 2025 AGENDA ITEM NUMBER: 4.2 SUBJECT: ERMU Commission Eligibility Requirements ACTION REQUESTED: Determine Eligibility Requirements for ERMU Commission Membership BACKGROUND: On June 3, 2024, the City Council adopted City Ordinance 24-14 - Amending Chapter 2, Article V, Boards and Commissions of the City of Elk River, Minnesota, City Code, which includes a provision that all City of Elk River commissions will review their bylaws annually. ERMU’s bylaws were reviewed at the March 11, 2025, commission meeting. Since that time, however, City staff have identified an oversight regarding ERMU commission member eligibility requirements as updated by Ordinance 24-14. During the update of the ordinance, eligibility requirements for the various city commissions were removed from city ordinance as part of an effort to shift meeting requirements to the respective commission/board’s bylaws. DISCUSSION: Since ERMU’s commission receives delegated authority from the City Council, best practice is to put commission eligibility requirements in city ordinance. In discussing next steps with City Administrator Cal Portner, it was determined the best course of action is to first discuss eligibility requirements with ERMU commission members, then bring proposed updates to the City Council for consideration when they revise the ordinance. The following ordinance requirements should be considered for implementation: • All Commissioners shall be ERMU customers, • Up to two commissioners may be City of Elk River Councilmembers, • At least one, preferably two, commissioner(s) shall be ERMU water customers, and • Up to one commissioner may live outside of Elk River city limits.
