RESOLUTION 96 - 5 A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION ACCEPTING BID AND AUTHORIZING EXECUTION OF CONTRACT IN THE MATTER OF THE WWTF UPGRADE OF 1996 WHEREAS, pursuant to City Council direction, competitive bids were solicited and received for the WWTF Upgrade as set forth m the bid tabulation attached hereto and incorporated herein by this reference; and, WHEREAS, the City Council has considered the amount of the bids and the responsibility of the bidders and determined that Gridor Construction, Inc., is the lowest responsible bidder; and, WHEREAS, the City Council has reviewed the revenue and expense projections of the Wastewater Treatment System fund and has determined that this project is financially feasible; and, a Declaration of Official Intent (as required by Treasury Regulations, Section 1.150-2 under the Internal Revenue Code of 1986, as amended) stating that the City expects to sell bonds for this project was signed on October 23, 1995. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: The Mayor and City Administrator are authorized and directed to execute, on behalf of the City, such contract with Gridor Construction, Inc., as is approved by the City Attorney for the completion of the WWTF Upgrade according to the approved plans and specifications. The City Administrator is authorized and directed to forthwith return to all bidders the deposits made with their bids upon execution of the contract above specified.
