<br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />~ <br /> <br />CITY OF ELK RIVER, MINNESOTA <br /> <br />ORDINANCE NO. 80-6 <br /> <br />AN ORDINANCE AMENDING SECTION 900.42, SUBSECTIONS 2 AND 3 <br />of the <br />ZONING ORDINANCE OF THE CITY OF ELK RIVER, RELATING TO CONDITIONAL USE PERMITS <br /> <br />THE CITY COUNCIL ORDAINS AS AN AMENDMENT TO THE ZONING ORDINANCE OF THE CITY OF <br />ELK RIVER: <br /> <br />Section 900.42, Subsections 2 and 3 of the Zoning Ordinance of the City of Elk River <br />is hereby amended to read as follows: <br /> <br />900.42 - Conditional Use Permits. <br /> <br />2. Planning Commission Review. On receipt of a completed application including <br />necessary plans and information, the Zoning and Building Administrator shall schedule <br />its review by the Planning Commission. The Planning Commission shall report its <br />findings and recommendations to the Council with regard to the application. <br /> <br />3. Council Action. On receipt of the report of the Planning Commission, the Council <br />shall hold a public hearing and shall make a decision upon the proposal to grant or <br />deny a conditional use permit. At least ten (10) days in advance of each hearing, <br />notice of the time and place of such hearing shall be transmitted to the applicant <br />and shall be published in the official newspaper. All property owners within three <br />hundred fifty (350) feet shall be notified by mail of the subject, time and place <br />of the public hearing.
