<br />. <br /> <br />. <br /> <br />~ <br /> <br />" <br /> <br />RESOLUTION 87-17 <br /> <br />A RESOLUTION REQUESTING MNDOT TO MAKE IMPROVEMENTS ON A PORTION <br />OF TRUNK HIGHWAY NO. 169 <br /> <br />WHEREAS, the State of Minnesota, Department of Transportation, proposes to <br />make certain improvements on a portion of Trunk Highway No. 169 <br />located in the City of Elk River in Sherburne County. <br /> <br />WHEREAS, it is the desire of the City that such improvements of said roadway <br />along said street be extended to greater width and capacity than is <br />necessary to accommodate normal trunk highway traffic at the <br />junction of Trunk Highway 169 and Elk Hills Drive. <br /> <br />BE IT RESOLVED by the Council of the City of Elk River that the State of <br />Minnesota, Department of Transportation is requested to provide for <br />improvements on the aforesaid portion of Trunk Highway 169 <br />consisting particularly of: grading: curb and gutter: base: <br />surfacing: storm sewer: traffic actuated signal system: etc., in <br />which the City will share in the cost. <br /> <br />BE IT FURTHER RESOLVED that following approval by the Minnesota Department of <br />Transportation of plans and specifications for said improvement of <br />said trunk highway and before a contract is awarded for the <br />costruction of said improvements, the City shall enter into an <br />agreement with the State which shall provide that the City shall pay <br />its share of the cost of the requested improvements as determined by <br />the State in keeping with its latest edition of MnDOT Policy <br />Guideline (a copy of wich has been received from the Minesota <br />Department of Transportation's District Engineer) and, that if the <br />State lets the costruction contract, the municipality will deposit <br />with the State upon demand, after the execution of the agreement and <br />before the start of construction, a sum equal to an estimate of the <br />City's share as prepared by the Minnesota Department of <br />Transportation. <br /> <br />The City shall, in addition to paying its proportionate share of the <br />cost of the proposed work, obtain at its sole cost and expense all <br />necessary right of way easements and construction permits for the <br />work to be performed outside the limits of the trunk highway or <br />established City streets and roads, together with all drainage <br />outlet rights where necessary. Such easements, permits and rights <br />shall be obtained and certified copies of them furnished the <br />Department of Transportation before any contract for the proposed <br />work is awarded. <br /> <br />Passed and adopted by the City Council of the City of Elk River, Minnesota on <br />the Sixteenth day of March, 1987. <br /> <br />(JJdb r ~d <br /> <br />Estelle E.
