<br />~ <br /> <br />. <br /> <br />RESOLUTION NO. 85-26 <br /> <br />City of Elk River <br />County of Sherburne <br />STATE OF MINNESOTA <br /> <br />RESOLUTION A14ENDING BY SUBSTITUTION THE <br />JOINT AND COOPERATIVE AGREEMENT OF THE SHERBURNE/WRIGHT <br />COUNTY CABLE COMMUNICATIONS COMMISSION <br /> <br />WHEREAS, the City of Elk River , (hereinafter <br />"City") has granted a cable communications franchise <br />ordinance to Rite Cable Company of Minnesota, Ltd.; <br /> <br />WHEREAS, on September 14, 1984, City was issued a <br />Regular Certificate of Confirmation by the Minnesota <br />Cable Communications Board relative to the Cable <br />Communications Franchise; <br /> <br />WHEREAS, City is an existing member of the Sherburne/ <br />Wright County Cable Communications Commission; <br /> <br />. <br /> <br />WHEREAS, City believes it to be in the best interest <br />and the most efficient utilization of resources for City <br />to amend the existing Joint and Cooperative Agreement to <br />provide for the Administration of the cable communications <br />system; <br /> <br />WHEREAS, said joint and cooperative effort is <br />authorized by Minnesota Statutes section 471.59, as <br />amended; <br /> <br />THEREFORE, BE IT RESOLVED, that the City Council <br />of the City of Elk River shall participate in the <br />Sherburne/Wright County Cable Communications Commission <br />for the administration of the cable communications system; <br /> <br />BE IT FURTHER RESOLVED, that the existing Joint and <br />Cooperative Agreement is amended by substitution of the <br />Joint and Cooperative Agreement For The Administration <br />Of A Cable Television Franchise; <br /> <br />FURTHER, that the appropriate officers of City shall <br />execute the Joint and Cooperative Agreement of the <br />Sherburne/Wright County Cable Communications Commission <br />and file it appropriately with the City Administrator <br />of the City of Monticello; <br /> <br />. <br />
