City of Ek [diver <br />City Council <br />Resolution 18- zz <br />A Resolution of the City Council of the City of Elk River Approving a Petition <br />to Vacate Park Land Dedicated With the Miske Meadows Subdivision <br />WHEREAS, application has been made by the owner of the Miske Meadows Subdivision <br />("Owner") to vacate the park land described in Exhibit A attached hereto <br />("Park"); and, <br />WHEREAS, the Owner has revised the preliminary plat for Miske Meadows; and <br />WHEREAS, the Parks and Recreation Commission has reviewed the revised preliminary <br />plat and has changed their recommendation for park dedication requirements <br />within the Miske Meadows Subdivision; and <br />WHEREAS, vacation of the Park is appropriate as land dedication is no longer <br />recommended or required for the subdivision, and the revised preliminary <br />plat of Miske Meadows approved by the Elk River City Council on January <br />16, 2018, no longer contains the Park; and <br />WHEREAS, a public hearing was held on April 16, 2018, before the City Council of the <br />City of Elk River on the application to vacate the dedicated park land after <br />published and posted notice had been given, and all persons interested were <br />given an opportunity to be heard at the public hearing. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk <br />River, Minnesota, as follows: <br />1. The petition to vacate the dedicated park land described in Exhibit A is hereby <br />granted; and, <br />2.
