E04y1� ,.,�� Request for Action <br /> River <br /> To Item Number <br /> Mayor and City Council 4.4 <br /> Agenda Section Meeting Date Prepared by <br /> ConsentJune 19, 2017 Tina Allard, City Clerk <br /> Item Description Reviewed by <br /> Repeal Mechanical Amusement Ordinance T.John Cunningham, Fire Chief <br /> Reviewed by <br /> Action Requested <br /> Adopt,by motion, an ordinance repealing Section 38-61 through 38-87,regarding amusement devices. <br /> Background/Discussion <br /> Council previously directed staff to amend certain licensing ordinances to allow for approval by staff with <br /> a chance for a hearing before Council if a license is denied. <br /> There is not a lot of background relating to why amusement devices tend to be licensed by cities. Possibly <br /> back in the 70's, amusement centers were trending and cities had concerns or issues with teenagers, noise, <br /> gambling, and littering. Most cities still license amusement devices. In doing research staff located two <br /> metro area cities who recently quit licensing them. <br /> Amusement devices are coin/token operated machines such as pinball, mechanical grab machines, or <br /> video, typically found in a movie theater or bar. There is no enforcement/inspection work performed by <br /> staff. The Office of the City Clerk processes the applications and the Police Department completes a <br /> background check only on the initial application unless there is a change in ownership. <br /> Staff would recommend repeal of the ordinance. If trends change in the future, and there are concerns <br /> with the operation of these types of devices, Council could address them at that time. <br /> Financial Impact <br /> ■ Current fee is $15 per establishment,plus $15 per device. <br /> ■ Collected fees of$980 from three licensees. (One company licenses multiple locations). <br /> ■ If a fee amount covers more than the cost of just issuing the license, the city should pro-rate the <br /> fee.
