Staff believes the EAW accurately describes the project and any potential <br />environmental impacts. Mitigation measures to reduce the environmental impacts have been identified <br />by the EAW and will be incorporated into the project plans. Staff recommends a Negative Declaration <br />on Need for an EIS for the ERX Motor Park request. <br />The Elk River City Council is the Responsible Governmental Unit (RGU) charged with determining from <br />the information gathered through the EAW process whether the project has significant potential to cause <br />irreversible environmental impacts. If the Council believes there is a significant potential to cause <br />irreversible environmental impacts, they shall order the preparation of an Environmental Impact <br />Statement (EIS) for the project. The Council will consider the following information: the EAW, <br />comments received on the EAW, and the responses to the comments received. <br />The Council shall order the preparation of an EIS if they determine the impacts may reasonably be <br />expected by the project to have the potential for significant environmental impacts. The Council shall <br />consider the impacts of the project under the following criteria: <br />■ The type, extent, and reversibility of the environmental effects. <br />Cumulative Potential Effects. The RGU shall consider the following factors: Whether the <br />cumulative potential effect is significant; whether the contribution from the project is significant <br />when viewed in connection with other contributions to the cumulative potential effect; the <br />degree to which the project complies with approved mitigation measures specifically designed to <br />address the cumulative potential effect; and the efforts of the proposer to minimize the <br />contributions from the project. <br />■ The extent to which the environmental effects are subject to mitigation by ongoing public <br />regulatory authority.
