<br /> <br />Item # 4.5. <br /> <br />MEMORANDUM <br /> <br />TO: <br /> <br />Mayor and City Council <br /> <br />FROM: <br /> <br />Joan Schmidt, City Clerk <br /> <br />DATE: <br /> <br />January 3, 2005 <br /> <br />SUBJECT: <br /> <br />Cable Franchise Documents <br /> <br />The City of Elk River is part of the Sherburne/Wright County Cable Communication <br />Commission. Robert V ose, Attorney for the Commission, and Merton Auger, Chair of <br />the Commission, have been negotiating with Charter Communications for a franchise <br />agreement. The current cable franchise agreement has had several extensions over the <br />past few years. Before you is an agreement that each Cable Commission member city <br />(consisting of Buffalo, Dassel, Watertown, Delano, Maple Lake, Monticello, Big Lake, <br />Cokato, Rockford, and Elk River) is asked to approve. This franchise agreement will be <br />in effect for a period of 15 years. <br /> <br />The Commission will receive franchise fees in an amount equal to 5% of its gross <br />revenues, which is used to buy cable equipment. Each city will also have two channels <br />dedicated for public, education, and government access (PEG) programming. Each city <br />will also receive $.85 per subscriber, per month to support community programming. <br />Both the franchise and PEG fees will be remitted on a quarterly basis within 60 days of <br />the close of the preceding calendar quarter. <br /> <br />ACTION REOUESTED: <br /> <br />1. Motion to approve Ordinance #05-01 establishing certain regulations governing <br />the delivery of cable service in the City to ensure that all cable providers are <br />subject to comparable obligations and burdens. <br /> <br />2. Motion to approve Ordinance #05-02 granting a franchise to CC VIII Operating <br />LLC dba Charter Communications authorizing operation of a cable system and <br />delivery of cable services in the City pursuant to the Cable Ordinance. <br /> <br />3.
