Green Qompany <br /> <br />Item 5.7. <br /> <br />March 3, 2004 <br />File: 230000M-0325 <br /> <br />Mr. Pat Klaers <br />City Administrator <br />City of Elk River <br />13065 Orono Parkway <br />Elk River, MN 55330 <br /> <br />RE: MNDOT PARTNERSHIP CONTRACT <br /> <br />Dear Mr. Klaers: <br /> <br />As directed by the City Council in February, I have had City Attorney Chds Johnson review the <br />attached MnDOT Partnership Contract, specifically looking at Section 10 - Termination. Mr. <br />Johnson has reported to me that these are standard provisions and that he feels overall the <br />partnership contract is a reasonable legal document. As I indicated in my previous memo <br />regarding this issue, we have been approached by MnDOT Distdct 3 requesting that the City <br />Council consider entedng into this Partnership Contract. It is my understanding that the contract <br />simply allows monies paid by the City of Elk River for services such as signal maintenance or <br />materials testing on street projects to flow back to District 3 from where the service was provided, <br />rather than into the general fund of MnDOT. Without this agreement, it is my understanding that all <br />fees paid by the City of Elk River for services provided by District 3 actually go back to the general <br />fund. <br /> <br />Attached is a draft resolution authorizing the City to enter into this partnership contract with <br />MnDOT.
