Mr. <br />Johnson has reported to me that these are standard provisions and that he feels overall the <br />partnership contract is a reasonable legal document. As I indicated in my previous memo <br />regarding this issue, we have been approached by MnDOT Distdct 3 requesting that the City <br />Council consider entedng into this Partnership Contract. It is my understanding that the contract <br />simply allows monies paid by the City of Elk River for services such as signal maintenance or <br />materials testing on street projects to flow back to District 3 from where the service was provided, <br />rather than into the general fund of MnDOT. Without this agreement, it is my understanding that all <br />fees paid by the City of Elk River for services provided by District 3 actually go back to the general <br />fund. <br /> <br />Attached is a draft resolution authorizing the City to enter into this partnership contract with <br />MnDOT.
