~/ <br />City of <br />Elk -~-- <br />River <br />REQUEST FOR ACTION <br />To Item Number <br />Plannin Commission 5.2. <br />Agenda Section Meeting Date Prepared by <br />Plannin Items Se tember 15, 2009 Jerem Barnhart, Plannin Mana er <br />Item Description Reviewed by <br />Request by DuffyDevelopmentfnr Site Plan Review Approval <br />of a 53-unit Apartment Conditional Use Pernut Approval to Reviewed by <br />Amend the Planned Unit Development Agreement, all in Lot 1, <br />Block 1 of Elk River Station 3`~ Addition. <br />Action Requested <br />Staff supports a Planning Commission recommendation to amend the Planned Unit Development <br />agreement, allowing 53 units, and parking at a ration of 2.32 spaces per unit. <br />Staff recommends that the Planning Commission recommend approval of the Site Plan, as <br />illustrated on drawings dated 9-3-09 with the following conditions: <br />1. All comments of the City Engineer's memos dated September 10, 2009 and March 10, <br />2008 shall be addressed. <br />2. All comments and conditions of the Environmental Technician memo dated March <br />4, 2008 shall be addressed. <br />3. The development shall meet all applicable fire codes. The Fire Chief shall verify the <br />location of all fire hydrants, and may require additional hydrants necessary to <br />preserve the health and safety of the residents. <br />4. A NPDES permit is required prior to final approval of construction drawings. <br />5. A letter of credit in the amount of 100% of the cost of the improvements, landscape, <br />and trail installation shall be submitted at the time of building permit application. <br />Per Section 30-604(b). <br />6. No building permit may be issued until the plat is recorded. <br />7. Landscaping plan be amended to incorporate native plantings along the wetland, <br />and a rain garden to management storm water run off prior to entering the wetland. <br />Background/Discussion <br />C-n June 16, 2008, the City Council approved the platting of Outlot D, Elk River Station into a buildable <br />lot: Lot 1, Block 1, Elk River Station 3'~ addition. At that time, the Council also approved the site plan <br />fora 60-unit, 4 story apartment building. <br />The original developer of the 60-unit apartment building has since abandoned the project. John Duffy, <br />Duffy Development, is now proposing a 53-unit affordable apartment building on the same site. The <br />building exterior will be consistent with the original design and the design standards of the PUD <br />agreement. <br />
